TERMS & CONDITIONS
1. Operator
BACK TO FUTURE is operated by [FULL LEGAL NAME / COMPANY], with registered or professional address at [REGISTERED/POSTAL ADDRESS], email [SUPPORT EMAIL], telephone [TELEPHONE — IF REQUIRED/USED], and tax/company identification [NIF / REGISTRATION DETAILS AS APPLICABLE].
2. The service you are purchasing
The paid product is a personalised digital report generated from information voluntarily submitted by the user. The report may include an integrated profile, current dynamics, qualitative future scenarios, turning points, indicators and a final synthesis. The report is created specifically for the user and delivered electronically, normally as a downloadable PDF.
The service is data-driven and interpretative. It is not fortune-telling, psychic or supernatural prediction, and it does not have access to undisclosed future events. Any scenario is conditional on the information supplied and may differ materially from what later occurs.
3. Informational nature and limitations
The report is provided for informational and analytical purposes. It is not financial, investment, tax, legal, medical, psychological, employment, insurance or other regulated/professional advice, and it should not be used as the sole basis for consequential decisions.
Any “data completeness” or “data sufficiency” score measures only the completeness and contextual richness of the submitted information. It is not a probability, confidence level or guarantee that a scenario will occur.
4. Eligibility
The service is offered only to persons aged 18 or over. By submitting the questionnaire or purchasing the service, the user confirms that they are at least 18 years old and legally capable of entering into the transaction.
5. User information and prohibited data
The usefulness of the report depends on the relevance, completeness and accuracy of the information supplied. Users are responsible for reviewing their answers before submission and must not provide unlawful content, credentials/passwords, highly confidential information or special-category/sensitive personal data that the service does not request. Users should provide information about themselves and must not submit sensitive or confidential personal data about third parties.
6. How an order is placed
The normal ordering process is: (1) complete the questionnaire; (2) review the information and service description; (3) view the total price and accepted payment methods; (4) accept these Terms and the Privacy Policy; (5) where required, expressly request immediate performance and acknowledge the applicable consequence for the right of withdrawal; (6) place the order using a button that clearly indicates an obligation to pay; and (7) receive the personalised report electronically after successful payment and generation.
Before placing the order, the user must be given a reasonable opportunity to identify and correct input errors. After conclusion of the contract, the user must receive the contractual information and any legally required confirmation of the express request for immediate performance / withdrawal acknowledgement on a durable medium, such as email or another form the user can retain.
7. Price, taxes, payment and invoicing
The total price payable, inclusive of applicable taxes where required, is the price clearly displayed immediately before the user places the order. The service is a one-time purchase unless a subscription or recurring service is expressly and separately offered and accepted.
Payment may be processed through Stripe, PayPal and/or other clearly identified payment methods. BACK TO FUTURE should not store complete payment-card numbers. A payment-provider receipt is not a substitute for any tax invoice that the operator is legally required to issue. The operator will issue the legally required invoice or invoice-receipt in accordance with the tax rules applicable to the transaction.
8. Immediate performance, withdrawal and no-refund rule
Because the personalised digital report is intended to be generated promptly after payment, the checkout will ask the user, where required by applicable consumer law, to expressly request that performance begin immediately during the statutory withdrawal period and to acknowledge the legal consequences of that request.
“I expressly request that BACK TO FUTURE begin generating my personalised digital report immediately, before the statutory withdrawal period has expired. I understand and acknowledge that, once performance has begun and the personalised digital content/service has been fully performed and delivered in accordance with applicable law, I may lose my statutory right of withdrawal.”
After lawful full performance and delivery, purchases are non-refundable to the extent permitted by applicable law. This no-refund rule does not remove mandatory consumer rights. A refund, price reduction, re-performance or other remedy may still be due where required by law, including in cases such as non-delivery, duplicate charging, defective or non-conforming digital content/service, or another legally protected situation.
The fact that a report is personalised does not, by itself, override mandatory consumer legislation. The checkout process and contractual confirmation must satisfy the legal requirements applicable to immediate digital performance and withdrawal.
9. Delivery, download access and technical failure
After successful payment, the service will make reasonable efforts to generate and deliver the report promptly. Generation time may vary because of network, payment-provider or AI-provider availability.
Unless a different limit is clearly stated before purchase, the current service permits up to three authorised PDF downloads during the 24-hour period beginning with the first authorised download. This access policy is a technical delivery rule and does not remove mandatory rights or remedies in cases of non-delivery, duplicate charging, defective/non-conforming digital content or service, or another legally protected situation.
If payment is confirmed but the report cannot be generated or delivered, the user should contact [SUPPORT EMAIL]. The operator will investigate and, where appropriate, re-perform the service or provide another remedy required by law.
10. AI and automated analysis
The user is informed before submission and purchase that automated processing and AI-assisted methods contribute materially to the report. The system analyses relationships between user-provided signals and generates conditional scenarios; it does not independently verify future facts and is not intended to make decisions producing legal or similarly significant effects concerning the user.
The report may contain AI-generated or AI-edited text. The operator remains responsible for the commercial service and for presenting the AI-assisted nature and limitations of the product clearly, including any transparency information required by the applicable EU Artificial Intelligence Act framework.
11. Digital-content/service conformity
Nothing in these Terms excludes mandatory rights relating to conformity, supply, functionality, accessibility, security or remedies for digital content or digital services. If the supplied report or delivery process fails to conform to mandatory consumer-law requirements, the user retains the remedies available under applicable law.
12. Intellectual property and permitted use
Except for third-party rights, the website design, software, original text, branding and service methodology are protected by applicable intellectual-property rules. The user may download, retain and use the purchased personal report for private, non-commercial purposes. No ownership of the platform, source code, algorithms, models, trade marks or underlying methodology is transferred.
13. Availability
Reasonable efforts will be made to keep the service available and secure, but uninterrupted availability cannot be guaranteed. Maintenance, payment-provider outages, AI-provider outages, network failures, force majeure and events outside reasonable control may temporarily affect the service.
14. Liability
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law. Subject to mandatory law, the operator does not guarantee that projected scenarios will occur and is not responsible for losses caused by treating a probabilistic report as a guaranteed prediction or as a substitute for qualified professional advice.
15. Privacy and data protection
Personal-data processing is described in the Privacy Policy. The Privacy Policy explains the use of AI-assisted processing, service providers, data retention, international transfers, user rights and security measures. Users should read it before submitting the questionnaire.
16. Complaints and consumer dispute resolution
Customer complaints may be sent to [SUPPORT/COMPLAINTS EMAIL]. Where the Portuguese Livro de Reclamações regime applies, the operator will maintain the required registration and provide access to the Livro de Reclamações Eletrónico.
Consumers may also use the competent Portuguese Alternative Dispute Resolution (RAL) entity where applicable. Before launch, the operator must identify the competent RAL entity or entities based on the actual establishment and scope of activity: [COMPETENT RAL ENTITY / CONTACT / WEBSITE]. Use of an out-of-court mechanism does not remove any right to seek judicial remedies where available.
17. Governing law and jurisdiction
If the operator is established in Portugal, these Terms are governed by Portuguese law, without depriving a consumer resident in another jurisdiction of any mandatory protections that apply to that consumer under applicable law. Any jurisdiction clause must be interpreted subject to mandatory consumer-protection rules.
18. Changes to these Terms
The version accepted at the time of purchase governs that transaction. Future changes apply only as permitted by law and will not retroactively remove rights already acquired by the consumer.
